1.CONTRACT
1. 1 These terms and conditions shall govern and form part of every contract for the sale of goods by Wildfire specified in the quotation (the Company"). Any terms or conditions of any other party to the contract ("the Customer"), whether submitted to the Company before or after these terms and conditions are submitted to the Customer, shall be invalid and of no effect.
1.2 No variation or exclusion of these terms and conditions or any part of them shall be effective unless such variation is expressed in writing and signed by a director of the Company. No other person has any authority to agree to any variation or exclusion or to make any warranties or representations on part of the Company.
1.3 These terms and conditions and the provisions of the quotation constitute the entire agreement between the parties hereto and all other representations, terms, conditions or warranties, whether express or implied (by statute or otherwise), are hereby excluded save that nothing contained in these terms and conditions shall or shall purport to exclude or limit the liability of the Company wherever such exclusion or limitation is prohibited, void or unenforceable under European law.
2. PAYMENT AND PRICE
2.1 All prices quoted by the Company are strictly net and no discounts or deductions whatsoever shall be allowed unless an arrangement has been agreed in writing by the Company.
3. DELIVERY AND RETURNS
3.1 Whilst the Company will endeavour to effect delivery within 24hours specified, such date or period is not to be of the essence of the contract and the Customer shall be bound to accept the goods ordered when available.
3.2 The Company shall not be liable in any way whatsoever (including for loss of profits or other consequential loss of the Customer) in respect of late delivery, howsoever caused, nor shall such failure to effect delivery within the period specified be deemed to be a breach of contract.
3.3 The company will accept returns up to 7 days from purchase date for faulty goods. An exchange service or full refund is available. The company will not be responsible for the postage costs for this service.
3.4 Should the company make a mistake with any part of the customers order, postage costs will be covered by the company.
3.5 The Company shall not be liable in any way whatsoever (including for loss of profits or other consequential loss of the Customer) in respect of items that are lost by the postal service.
4. WARRANTY AND LIABILITY
4.1 The Company warrants that the goods described on our website shall be supplied free from any defects arising from faulty materials or workmanship.
4.2 In the event that the Customer notifies the Company of any defect arising from any faulty materials within 14 days from the date of delivery, the Company undertakes, at its sole discretion, to replace the goods. This warranty is subject to the Customer notifying the Company as soon as is reasonably practicable of the faulty materials. Where it transpires that the materials were not faulty, the Customer shall pay to the Company all costs and expenses incurred in responding to the Customer.
4.3 Save for its obligation under clause 5.2 above, the Company shall not be liable in any way whatsoever for any costs or any loss or damage caused by defects in materials or workmanship (including its own negligence or that of its agents), In any event the Company's liability shall not exceed the amount paid to it by the Customer for the relevant goods or services.
5. FORCE MAJEURE
5.1 The Company shall not be liable in respect of any non performance or delay in performance of its obligations under this contract where this is caused directly or indirectly by anything outside its reasonable control.
6.GENERAL
6.1 These terms and conditions and the contract are governed by and shall be construed in all respects in accordance with European Law. Any dispute arising hereunder shall be referred to the Irish courts.
6.2 Unless otherwise specified it should be assumed by the purchaser that all metals, gem stones, crystals or other precious or semi-precious objects are simulation, base or non-precious.
6.3 The headings to these conditions are for assistance only and do not affect their construction.
